Terms & conditions

These Terms govern your use of the ECOGRAM mobile app and website (the "Service"), operated by HN Organic Firm Private Limited, Assam, India ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & accounts

• You must be at least 13 years old to use the Service. Business and vendor accounts must be 18+ and legally able to enter contracts.
• Account information you provide must be accurate. You are responsible for keeping your password safe and for activity under your account.
• One person per account. Sharing credentials is prohibited.

2. Roles on the Service

• Shopper — anyone can sign up to browse and buy at retail prices.
• Business — verified accounts (PAN + GST required) unlock wholesale pricing and the right to place bids in auctions.
• Vendor — farmers and co-ops who list products. Vendor accounts require review and approval before going live.
• Distributor — partners who hold stock lots and ship orders to buyers.

3. Listings & organic certification

• Vendors warrant that every listed product is grown without synthetic pesticides, herbicides or fertilisers, and carries a valid PGS-India Organic or Jaivik Assam certificate.
• Listings must include accurate description, weight/unit, price, harvest date, and certification details. Misleading or non-organic listings will be removed and the vendor may be suspended.
• We do not manufacture or grow the products listed on the Service. Final responsibility for product quality and safety rests with the vendor.

4. Orders, pricing & payment

• Prices are displayed in Indian Rupees (₹) and include applicable taxes unless stated otherwise.
• All retail and wholesale orders are Cash on Delivery. Payment is collected by the distributor when the order is handed over.
• An order is confirmed only when you receive an in-app confirmation. We may cancel orders due to stock shortages, suspected fraud, or pricing errors; in such cases you are not charged.
• Delivery timelines depend on the distributor and your location. We make no guarantee of a specific delivery date.

5. Auctions

• Only verified business accounts may place bids. Each bid must meet or exceed the displayed minimum increment.
• A submitted bid is a binding offer to purchase at that price if you are the highest bidder when the auction closes.
• If you win, the order is created automatically and delivered by the listed distributor on cash-on-delivery terms.
• We reserve the right to cancel an auction or invalidate bids in case of error, fraud, or technical failure.

6. Returns, refunds & quality complaints

• Inspect your delivery at handover. You may refuse delivery and not pay if items are damaged, spoiled, or substantially different from the listing.
• Quality complaints after acceptance must be reported within 48 hours via support@ecogram.store with photos. We coordinate with the vendor/distributor on a remedy (replacement or refund where appropriate).
• Perishable items are non-returnable once accepted unless quality issues are reported within the window above.

7. Vendor & distributor obligations

• Maintain a valid organic certification at all times. Provide a current certificate copy on request.
• Fulfil accepted orders promptly and honour the listed price.
• Pay applicable taxes (GST etc.) on sales made through the Service.
• We may suspend or terminate vendor / distributor accounts for fraud, expired certification, repeated quality issues, or breach of these Terms.

8. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to list non-organic produce as organic.
• Reverse-engineer, scrape, or interfere with the Service.
• Impersonate another person or business.
• Upload content that infringes someone else's rights.

9. Intellectual property

The ECOGRAM name, logo, app, website, and design are our property. You may not copy or reuse them without written permission. Content you upload (product listings, photos) remains yours, but you grant us a licence to host and display it for the purpose of operating the Service.

10. Account termination & deletion

• You may delete your account anytime at ecogram.store/delete-account.
• We may suspend or terminate accounts that violate these Terms, with or without notice depending on the severity.
• Some records (tax-related orders, fraud-prevention logs) may be retained as required by law after deletion.

11. Disclaimers & liability

The Service is provided "as is". To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid through the Service in the 6 months preceding the claim.

12. Governing law

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at Guwahati, Assam.

13. Changes

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date and announced in-app. Continued use after the change means you accept the updated Terms.
